The subject of data protection

The subject of data protection is personal data. According to § 3 sect. 1 BDSG (Federal Data Protection Act of Germany) these are individual details about personal or factual circumstances of an identified or identifiable natural person. This includes, for instance, information such as your name, postal address, e-mail address, or telephone number, but also usage data if applicable.

The following declaration gives you an overview of how we guarantee this protection and what kind of data is collected for what purpose.

Data processing on this website

The zweikern KG automatically collects and stores in its server log files information that your browser transmits to us. These are:

  • Browser type/ version

  • current operating system

  • Referrer URL (the previously visited page)

  • Hostname of the accessing computer (IP address)

  • Time of the server request

This data cannot be assigned to specific persons by zweikern KG. This data will not be merged with other data sources, and the data will be deleted after a statistical evaluation.

Data entered by users

You can only use the company analysis of zweikern KG after prior registration. For this, you have to enter your e-mail address and choose a password. This data is required by us to ensure that you can use the complete offer. Last but not least, we need this and, if necessary, other data to be able to respond to your questions, requests, and criticisms.

You also have the option of personalizing your account. For example, you can post a photo, choose a user name, and establish a connection to your Facebook user account. There is no obligation to personalize your account. This is done solely voluntarily.

If you use the company analysis within a registered account, all entered data and results will be synchronized with a database. The database's purpose is to enable you to access the analysis on different devices and to retrieve your tasks anywhere and any time. The data is transferred to the respective end devices using SSL encryption so that your data is transferred securely.

We use personal data to enable secure, effective, and user-related use of the company analysis, among others for:

  • the internet-based retrieval of analysis results,

  • the anonymous statistical evaluation of the analysis results for the preparation of findings and measures, for press releases from zweikern KG and studies,

  • the recommendation of zweikern by you via the Invite function to friends and acquaintances (e-mail address).

Disclosure of data

In principle, we do not pass on your data to third parties without having informed you in advance and asking for your permission. Only in the exceptional cases explained below can we transfer your data to third parties without prior separate information:

  • If it serves to clarify an illegal use or is necessary for legal prosecution, personal data will be forwarded to the law enforcement authorities and possibly to harmed third parties. However, this only happens if there are concrete indications of illegal or abusive behavior. A transfer can also take place if this serves the enforcement of general terms and conditions or other agreements.

  • We are also legally obliged to provide information to certain public bodies upon request. These are criminal prosecution authorities, authorities that prosecute administrative offenses subject to fines and the tax authorities. Occasionally, we are dependent on contractually affiliated external companies and external service providers for the provision of our services, for example in the areas of sending advertising (only if you have explicitly agreed to this beforehand), processing payments (PayPal, credit card, etc.), storing your data and customer service. In such cases, information is passed on to these companies or individuals for further processing. These external service providers are carefully selected and regularly reviewed by us to ensure that your privacy is protected. The service providers may only use the data for the purposes specified by us. Furthermore, the service providers are contractually obliged by us to treat your data exclusively following this data protection declaration and the German data protection laws.

As part of the further development of our business, the structure of the zweikern KG may develop as the legal form is changed, subsidiaries, parts of companies or components are founded, purchased, or sold. In such transactions, the customer information is passed on together with the part of the company to be transferred. Whenever personal data is passed on to third parties to the extent described above, zweikern will ensure that this is done following this data protection declaration and the relevant data protection laws.

The following information will inform you about the contents of our newsletter as well as the registration, dispatch, and statistical evaluation procedures and your rights of objection. By subscribing to our newsletter, you declare your agreement with receiving the newsletter and with the described methods.

Content of the newsletter
We send newsletters, e-mails and other electronic notifications containing advertising information (from now on referred to as " Newsletter ") only with the consent of the recipient or a legal permission. If the contents of the newsletter are accurately described within the scope of registration, they are decisive for the consent of the user. Also, our newsletters contain information on topics relating to corporate development and change processes, in particular from the field of psychology, as well as on our company (this may include in specific references to blog entries, lectures or workshops, our services or online appearances).

Double-Opt-In and Logging
The registration to our newsletter takes place in a so-called Double-Opt-In procedure. This means that you will receive an e-mail after your registration in which you will be asked to confirm your registration. This confirmation is necessary so that nobody can register with foreign e-mail addresses.

The registrations for the newsletter are logged in order to be able to prove the registration process according to the legal requirements. This includes the storage of the registration and time of confirmation, as well as the IP address. Likewise, the changes in your data stored with MailChimp are logged.

Use of the "MailChimp" distribution service
The newsletter is sent via "MailChimp," a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The e-mail addresses of our newsletter recipients, as well as their other data described in the context of this notice, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate newsletters on our behalf. Furthermore, according to its own information, MailChimp may use this data to optimize or improve its own services, e.g., for the technical optimization of the dispatch and presentation of the newsletter or commercial purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them on its own or to pass them on to third parties.

We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement "Privacy Shield" and is therefore committed to complying with EU data protection regulations. Besides, we have signed a data processing agreement with MailChimp. This is a contract in which MailChimp commits itself to protect the data of our users, to process them on our behalf in accordance with their data protection regulations and, in particular, not to pass them on to third parties. Registration data
To subscribe to the newsletter, it is sufficient to enter your e-mail address.

Optionally we ask you to enter your first and last name. This information is only used to personalize the newsletter. We also invite you to optionally enter your date of birth, gender, and field of business. We only use this information to adapt the contents of the newsletter to the interests of our readers.

Statistical data collection and analysis
The newsletters contain a so-called "web-beacon," i.e., a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. Within the scope of this retrieval, technical information such as information about the browser and your system, as well as your IP address and time of retrieval, are first collected. This information is used to technically improve the services on the basis of the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or access times.

The statistical data collection also includes determining whether the newsletter is opened, when it is opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is neither our nor MailChimp's aim to observe individual users. The evaluations rather serve us to recognize the reading habits of our users and to adapt our contents to them or to send differentiated contents according to the interests of our users.

Online access and data management
There are cases in which we direct the newsletter recipients to the MailChimp websites. For example, our newsletters contain a link with which the newsletter recipients can call up the newsletters online (e.g., in the case of display problems in the e-mail program). Furthermore, newsletter recipients can subsequently correct their data, such as the e-mail address. Likewise, the privacy policy of MailChimp is only available on their website.

In this context, we would like to point out that cookies are used on the MailChimp websites and that personal data is processed by MailChimp, its partners, and service providers (e.g., Google Analytics). We do not influence this data collection. Further information can be found in MailChimp's privacy policy. In addition, we inform you about the possibilities of objection to the data collection for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European area).

Cancellation/revocation
You can cancel the receipt of our newsletter at any time, i.e., revoke your consent. At the same time, your consent to the dispatch of the newsletter via MailChimp and the statistical analyses will expire. A separate revocation of the dispatch via MailChimp or of the statistical analysis is unfortunately not possible.

Legal framework Basic Data Protection Ordinance
In accordance with the provisions of the European General Data Protection Regulation (GDPR), which came into force on 25 May 2018, we would like to inform you that your consent to the sending of e-mail addresses is based on Art. 6 section 1 lit. a, 7 GDPR and § 7 section 2 No. 3 or section 3 UWG. The use of the MailChimp distribution service, the performance of statistical data collection and analysis as well as the logging of the registration procedure are carried out on the basis of our legitimate interests pursuant to Art. 6 section 1 lit. f GDPR. Our interest is directed towards the use of a user-friendly and secure newsletter system that serves both our business interests our user's expectation.

We would also like to point out that you may object at any time to the future processing of your personal data in accordance with the statutory provisions under Art. 21 GDPR. The objection can be made in particular against the processing for purposes of direct marketing.
